Dear Senators Romanchuk, Huffman, Ingram, Reynolds, Smith, and Representatives Holmes, Liston, Gross, Lipps, and Thomas,


I am writing to raise an urgent concern regarding the Ohio Department of Medicaid’s (ODM) continued failure to implement the new administrative rule under OAC 5160-1-40, effective July 1, 2024. This rule brings Ohio's Electronic Visit Verification (EVV) system in line with federal standards, removing the requirement for electronic tracking of live-in family caregivers and the disabled individuals they care for. ODM approved this exemption through Ohio’s rule-making process in spring 2024, and it has been in effect since July 1. However, despite opening the application process for EVV exemptions for live-in caregivers earlier this year, ODM has yet to process a single application.


ODM claims that a technological issue prevents them from processing over 2,500 pending exemption applications. This "glitch" has gone unresolved for months; meanwhile, ODM has had no difficulty deploying its new Provider Lookup Dashboard, which appears to be a higher priority. Although the exemption in OAC 5160-1-40 has been in effect for nearly half a year now, family caregivers are still being subjected to unnecessary surveillance, and the state is needlessly expending resources on monitoring live-in workers who are legally exempt from EVV. This issue persists solely due to ODM's failure to approve the pending exemption applications.


Since there appears to be no timely solution for this computer issue, ODM should be required to approve these applications manually by emailing exempted caregivers directly. If the glitch is eventually repaired, ODM could update its systems at that time.


We respectfully urge JMOC to intervene and require ODM to comply with its own administrative rule immediately by approving these applications—manually, if necessary—without further delays or excuses.
